Terms & Conditions
Charlotte Anne Studio is a subsidiary branch of Flying Lizard Designs Ltd. Charlotte Anne Studio is a trading name used by Flying Lizard Designs Ltd for the illustration, art and product sector of our business. All financial transactions will be conducted by us under the name Flying Lizard Design Ltd - registered company number 09241754.
Should you continue to use the site/service, and/or place an order, this constitutes complete acceptance of the following terms and conditions:
1. Payment
Credit card, debit card or bank transfer are our preferred methods of payment and orders from the website will only be actioned once checkout and payment has been completed and we have issued you an order acceptance email (see clause 13).
2. Cancellation
Please notify us via email at cas@flyinglizarddesign.co.uk if you would like to cancel your order. Due to the nature of our gifts, they could well be in design and production process and therefore this is subject to the discrepancy of Charlotte Anne Studio. These Terms & Conditions are in addition to your statutory rights as a consumer, which remain unaffected. Orders will not be regarded as cancelled until you have received a response from us acknowledging cancellation.
3. Production and delivery times
When we confirm your order we will give you a guideline delivery date. We know that timing is important, particularly for gifts, and guideline delivery dates are given in good faith. However, because some of our products are pieces of art, unfortunately they cannot be guaranteed. As a guide, we aim to complete your product within 14 days however it may take up to 28 days during peak periods, but given the individual nature of the process and the parties that are involved to complete the production of your gift, we will confirm this when you order. We will do our best to let you know if there is a delay for any reason. Commissions for original artwork cannot be instigated via the website and will be subject to a consultation process before work can begin. If you have a specific date you need your gift for, please contact us at cas@flyinglizarddesign.co.uk and we will do our very best to get your product to you in time. Please note that as some of our products are individually created by hand it is not always possible for us to do so.
We aim to deliver all UK orders within 3 working days of completion of the artwork. If, for any reason we expect a longer delivery time, you will be contacted immediately.
4. Artistic interpretation
Charlotte is an artist; when you place an order with Charlotte Anne Studio, you are commissioning a piece of art.
Each piece is custom-made and represents Charlotte’s artistic interpretation of the requested product. Whether you request a proof or not, by confirming and paying for your order you accept that the goods provided will be a work of art, with all elements of the composition subject to the creation and interpretation of the artist.
We cannot be held responsible for differences of artistic interpretation and all artistic decisions remain with Charlotte Anne Studio.
5. Product availability
We endeavour to have all our products available on demand. However, due to the fact that some of our gifts are handmade to order, occasionally during peak periods some gifts may have longer lead times. If so Charlotte Anne Studio will inform you immediately of any delays or subsequent unavailability. Any of our items which are unavailable will show this message on our website.
6. ALL PRODUCTS SOLD BY CHARLOTTE ANNE STUDIO ARE FOR DISPLAY PURPOSES OR DAILY USE ONLY AND ARE NOT TOYS.
7. Delivery address
Your order will be delivered to the address given at the time of the order. During checkout you will be given the option of entering a different delivery address if required.
8. Returns
We want you to be 100% satisfied with your purchase. If, however, any items do not meet your expectations, please contact us upon receipt, and we will do our best to rectify the situation.
Artwork that is personalised, bespoke or made-to-order to your specific requirements are non-refundable and can only be returned if they are faulty, an error has occurred or they have been mis-described. Unfortunately, because each product is an individual piece of art, once the order is confirmed and payment is received we cannot accept returns or give refunds. Should your product not correspond with your specific instructions, then we will either send a replacement or offer a full refund. PLEASE CHECK WHEN ENTERING INFORMATION ON ANY PERSONALISED PRODUCTS CAREFULLY.
This policy does not affect your consumer legal rights where goods are faulty or mis-described.
Any refund agreed by Charlotte Anne Studio and Flying Lizard Designs Ltd will be given in the form of the original method of payment. Goods should be received back with us as new and the packaging encasing any unframed print, framed original artwork, greetings card or boxed gift should not have been opened. Customers are advised to obtain a Royal Mail tracking number on the returned goods. We cannot be held responsible for lost or stolen parcels.
9. Faulty or damaged goods
Every effort is made to make sure your goods arrive in perfect condition. Please check delivery contents as soon as possible after delivery. In the unlikely event of your goods being damaged in transit, please report problems to us promptly as a delay might jeopardise any claim.
If you believe your item is faulty or damaged, please email us at cas@flyinglizarddesign.co.uk detailing, in full, the damage or fault relating to your order. Please provide photographic evidence to support your claim; this will speed the process up, particularly if it involves a third party (e.g. the courier).
10. Privacy
Charlotte Anne Studio and Flying Lizard Design Ltd fully respect and are committed to protecting customers’ privacy. See Prviacy policy for further details.
11. Cookies
We may use technology to track the patterns of behaviour of visitors to our site(s). This can include using a ‘cookie’, which would be stored on your browser. You can usually modify your browser to prevent this happening if you wish. The information collected in this way can be used to identify you unless you modify your browser settings. 12. Intellectual property
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in our literature and websites shall remain at all times vested in Charlotte Anne Studio and Flying Lizard Designs Ltd. You are permitted to use this material only as expressly authorised by us.
You acknowledge and agree that the material and content contained within the website is made available for persons non-commercial use only and you may (if necessary to make a purchase on the website) download such material and content to show others. Any other use of the material and content of the website is strictly prohibited (unless permission has been granted).
You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
13. Order process and contract formation
The steps required to create a contract of sale between you and Flying Lizard Designs Ltd are as follows:
On our website, you will be guided through the process of placing your order by a series of step by step instructions;
You will place your order by pressing the payment button during the check out process;
we take payment from you at the time you place your order, using the credit or debit card details supplied by you during the checkout process. Please note that this payment is not an acceptance by us of your order or evidence of any contract;
Your order is always subject to our acceptance. We reserve the right to decline or cancel any order without reason being given.
Acceptance of your order and the completion of the contract between you and Flying Lizard Designs Ltd will only take place when we issue you an order acceptance email detailing the goods and the price and a reference to these terms and conditions.
Should your order be rejected by us for any reason, you will be issued with a full refund for the entire sum of your transaction.
14. Trading name and structure
‘Charlotte Anne Studio’ is a trading name of Flying Lizard Design Ltd and artist Charlotte Anne Smirthwaite Walker (referred to here variously as ‘Charlotte’). Our trading addresses are Rosebank Cottage, Stapleford lane, Brough, Nottinghamshire, NG23 7QD, UK and The Paddock, Fletchers Bridge, Cardinham, Cornwall, PL30 4AN, UK.
15. Prices
All prices shown in this website are quoted in pounds sterling and are inclusive of VAT (we are not a VAT registered company) if and where applicable. Credit cards sales will be charged in your local billing currency by your credit card provider. Please refer to their terms and conditions.
16. Accuracy of information on the website
We have tried to ensure that information provided through this website is accurate but we accept no liability for inaccuracies, errors or omissions through technical or other reasons. Everything on this site is provided “as is” and “as available” without warranty of any kind, either expressed or implied. We make no representation or warranty of any kind that the website be timely or error-free, that defects will be corrected, or that the site or the server are free of viruses or other harmful components. Use of this site is at you own risk, and you will be responsible for the entire cost of all necessary servicing, repair or correction. We will not be responsible or liable for any loss of content or material uploaded or transmitted through the website or to our Flying Lizard Design email address and we accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
Flying Lizard Designs Ltd reserves the right at any time and without prior notice to make modifications, improvements, corrections and/or changes to the material on this site.
The product specifications listed in this website are given in good faith based on the specifications provided by the company(s) used for printing, framing and couriering. However, these may vary depending on circumstance or through changes beyond our control and we cannot be held liable should this occur.
17. Third party references
Reference to any third party in this website or other correspondence does not necessarily constitute or imply the endorsement, approval or connection with or by Flying Lizard Designs Ltd or Charlotte Anne Studio. We have not reviewed any websites linked to this site and are not responsible for their content.
18. Governing law and statutory rights
These Terms and Conditions, and all transactions undertaken through this website are governed by the laws of England. Any legal actions arising out of such transactions shall be subject to the English Legal processes and under the jurisdiction of English Courts. English is the only language offered for the conclusion of the contract.
In the event that any portion of these Terms and Conditions is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect. Charlotte Anne Studio’s failure to insist upon strict performance of any provision herein shall not be construed as a waiver of any provision or right. Neither the course of conduct between any party referred to herein nor trade practice shall act to modify any provision of these Terms and Conditions.
Nothing in this agreement affects the statutory rights of a consumer. Subject thereto all representations, warranties, guarantees and conditions express or implied, statutory or otherwise are expressly excluded and Charlotte Anne Studio does not accept liability for loss, damage, or injury howsoever arising.
